Terms of Use

These terms apply when you visit or use TMPY, operated by Tmpy Inc and based in Austin, Texas (“we”, “us”), including the website, the dashboard and anything else we offer. By using TMPY, joining the waitlist or signing in, you agree to them. If you do not agree, please do not use TMPY.

1. TMPY is an alpha

TMPY is an early, unfinished product. We may add, change, limit, pause or remove any part of it, or shut it down, at any time and without notice. Access is by invitation, and we decide who gets in and for how long.

2. What TMPY provides

TMPY provides read-only market information, including stock prices, charts, scanners, rankings, scores, indicators, news summaries, and automated explanations.

TMPY does not place, route, execute, or manage trades; connect to your brokerage account; hold your funds or securities; or manage your investment portfolio.

All content is provided for general informational and research purposes. It is not personalized investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any security. A score, ranking, alert, or inclusion in a watchlist does not establish that an investment is suitable for you.

Personalizing your watchlists, filters, or display does not mean TMPY has assessed your financial circumstances, investment objectives, or risk tolerance. You remain responsible for independently verifying information and making your own investment decisions.

Nothing in these Terms excludes a duty imposed by applicable law.

3. Who can use TMPY

You must be at least 18 years old and located in the United States. By using TMPY you confirm that you meet these requirements, that you have the legal capacity to agree to these terms, and that the information you give us is true and up to date. You may not use TMPY if you have been barred from it before.

4. Risk and automated content

Some content is written by automated tools and can be wrong. You may choose to trade elsewhere based on what you see on TMPY, and you do so at your own risk. Trading is risky and you can lose money. Past performance does not predict future results.

5. Data may be late or wrong

Market data, news and other content come from third parties and automated systems. They may be delayed, incomplete or incorrect, and we do not promise otherwise. Always check important information with another source.

6. Your account

You sign in with a Google account. Keep it secure and do not share your access. You are responsible for everything done through your account, and you must tell us promptly if you think someone else has used it. We may suspend or end your access at any time, for any reason or no reason.

7. Fair use and prohibited activities

Use TMPY only for your own personal, non-commercial use. You agree not to:

• copy, resell, redistribute, scrape or bulk-download its content or data, including with bots, crawlers or other automated tools;
• use TMPY content or data to build, train or improve a competing product or service;
• try to break, overload, probe or get around its security or access limits, or use it from outside the United States by hiding your location;
• introduce viruses or other harmful code, or interfere with anyone else’s use of TMPY;
• pretend to be someone else, or use another person’s account;
• reverse engineer or try to extract the source code of TMPY, except where the law allows it;
• try to reverse engineer, reconstruct or copy TMPY’s scores, ratings or the methods behind them, including the TMPY Score;
• access TMPY other than through the website or apps we provide, for example by calling its data services directly from your own scripts or tools; or
• use TMPY in any unlawful way, including to manipulate markets or to mislead others about securities.

8. Our content

TMPY, its design, software and content belong to us or our licensors and are protected by copyright, trademark and other laws. You get a limited, personal, revocable, non-transferable permission to use TMPY under these terms, and nothing more. Market data and news belong to their providers and may carry their own conditions.

9. Feedback

If you send us feedback, ideas or suggestions, we may use them freely and without owing you anything.

10. Third-party services and links

TMPY relies on and may link to services we do not run, such as Google sign-in, data and news providers, and linked articles. We do not control them and are not responsible for them, their content or their terms. Using them is at your own risk.

11. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using TMPY you agree to it.

12. No promises

TMPY is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises of any kind, express or implied, including that TMPY will be accurate, reliable, available, secure, error-free or fit for any purpose, and including any implied promise of merchantability, fitness for a particular purpose or non-infringement.

13. Limits on our responsibility

To the fullest extent the law allows, we and our owners, staff and suppliers are not responsible for any loss or damage of any kind arising from or connected to your use of TMPY, or your reliance on anything in it, including trading or investment losses, lost profits, data or opportunities, and indirect, incidental, special, consequential or punitive damages, even if we were told they were possible. If we are found responsible anyway, our total responsibility is limited to US $50. Some places do not allow some of these limits, so they may not apply to you in full.

14. You cover us

If your use of TMPY or your breaking of these terms leads to a claim against us, you agree to cover our losses and costs, including reasonable legal fees.

15. Ending your use

You can stop using TMPY at any time. We can suspend or end your access at any time. When access ends, your permission to use TMPY ends too. The parts of these terms that by their nature should survive, such as sections 4, 5, 8, 12, 13, 14 and 17, continue to apply.

16. Changes

We may change these terms at any time. The new version applies from when we post it here, and the “Last updated” date above shows when. If you keep using TMPY after that, you accept the new terms.

17. Everything else

TMPY is offered in the United States only. These terms are governed by the laws of the State of Texas and applicable US federal law. Any dispute will be handled in the state courts in Travis County, Texas, or the U.S. District Court for the Western District of Texas, Austin Division, subject to mandatory consumer protections. You may not transfer your rights under these terms; we may transfer ours. We may give you notices by posting them on TMPY or by emailing the address linked to your account. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part, we have not given it up. These terms, together with our Privacy Policy, are the whole agreement between you and us about TMPY.
